As a tour operator with more than three decades experience, at Andean Adventures Peru our priority is the quality of service we offer travelers from all over the world when they visit us to experience the many wonders of Peru and our neighboring countries. We want to provide the best possible service, while offering the highest standards of excellence, safety and security.
While you are a guest in our country, we will do everything possible to solve any issues you may have. It is in the interests of transparency that we publish here our Terms and Conditions, so that they can be read by everyone interested in entrusting us with their Peru vacation.
Thank you for choosing to travel with Andean Adventures Peru SRLTDA (referred to hereinafter as “Andean Adventures Peru” or “AAP”). The following Terms and Conditions apply to all travel products and/or services purchased from AAP, and govern the contractual relationship between you and AAP with respect to any such travel products and/or services (referred to hereinafter as the “Product” or “Products”). All AAP tours and activities are operated by AAP, unless specified as a third-party operation. Tours and activities based in other countries are provided through affiliated companies and are listed as such under each product on the website. We ask that you read these Terms and Conditions carefully, because by booking any Product with AAP, or by traveling on an AAP tour or Product, you acknowledge that: I) You have read and understand these Terms, and II) You indicate your express acceptance of these Terms and you agree to be bound by them. If you have confirmed a reservation for any Product with more than one customer named and booked as part of that reservation, you will be deemed to have accepted these Terms and Conditions (“Terms”) on behalf of all the customers named in the reservation (including minors and those with a disability) and traveling or participating in any Product (hereinafter “you”, the “Customer” or “Customers”), and by such travel or participation, all participants indicate their acceptance of these Terms. The customer who confirmed the reservation is considered the designated contact person for all other customers mentioned in said reservation.
Bookings:
To guarantee reconfirmation, bookings must be made at least 48 hours before the scheduled date for arrival.
In order to reserve and confirm any of our tours or bespoke itineraries for groups or individual travelers, the following information must be sent to us via our booking form or email address:
- Full name as it appears in the holder’s passport
- Passport number valid on the scheduled date of travel
- Nationality
- Date of birth
- Gender
- Address and phone number
- Email address
- Arrival and departure dates
Passport and visas
As a traveler, it is your responsibility to ensure that all necessary travel documents are valid and up to date before you travel. Passports are required for all international travel and must be valid for at least six months after the scheduled return date. In addition to passports, you may need to obtain visas, permits or vaccination certificates, depending on your destination.
Please note that it is your sole responsibility to verify all entry requirements, including passport validity and visa requirements, for each country on your itinerary. You assume all responsibility for the consequences of incomplete or faulty documentation. While we may provide in good faith information or advice on visas, vaccinations, weather, clothing, baggage and other matters, we are not responsible for errors or omissions in the information provided.
Please note that all tickets included in your travel package are unalterable and non-transferable once issued in your name and with your passport number. If you renew your passport after booking, for identification purposes you will need to bring both your old and new passports, particularly for trips that include control points and Peruvian Ministry of Culture checkpoints at tourist attractions, such as the Inca Trail and Machu Picchu.
If you do not have the correct and valid documents, you will be responsible for all expenses related to obtaining any and all new entrance tickets to the attractions. We strongly recommend that you check and re-check all necessary documents well in advance of your departure date, in order to ensure a hassle-free travel experience.
In order to process your booking in a timely manner:
We require a deposit of 50% (fifty percent) of the total cost of the selected itinerary at time of booking. The balance must be paid no later than 30 days before the scheduled arrival date.
Advance booking:
To ensure availability, bookings should be made as far in advance as possible. For example, the 2-day, 3-day and 4-day Inca Trail is in high demand throughout the year and we recommend that you make your reservation as soon as you have received our confirmation of availability.
Last-minute bookings:
Bookings will be accepted between 29 and 2 calendar days (48 hours) before the start of service. Payment must be made as soon as confirmation has been received.
Single accommodation:
Our rates are based on twin or double room accommodation; a single supplement is available. Single room accommodation can also be provided upon request, at an additional cost.
Cancellations:
In our experience prior to 2020, a small percentage of bookings were cancelled by the client before departure due to some unforeseen circumstance. The penalties incurred for cancellation of services will depend on the date of cancellation, in accordance with the following conditions:
- At any time up to 30 days before the service: Andean Adventures Peru will not charge a penalty, with the exception of itineraries involving the network of Inca Trails. Once confirmation has been received of the purchase of the entrance to the Inca Trail, the client will lose the total amount paid for the non-refundable entrance fee as well as any and all administrative costs, in accordance with Ministry of Culture conditions. (1) after confirming the purchase of your Inca Trail permit, we will charge the full cost of said permit.
- 29 to 16 days before the scheduled start of services: 40% of the total cost of the service will be retained by the company.
- 15 to 07 days before the scheduled start of services: 60% of the total cost of the service will be retained by the company.
- 06 to 02 days before the scheduled start of services: 80% percent of the total cost of the service will be retained by the company.
- From 02 days before to the same day of the scheduled service, 100% of the total cost of the service will be retained by the company.
Greater flexibility for the “new normal”:
At Andean Adventures Peru, we share the concerns of travelers who may be worried about what could happen if they need to cancel or postpone their Peru vacation as a result of events or circumstances related to the global health emergency in their home country or in Peru.
Cancellation or postponement due to force majeure:
In response to the global situation resulting from the coronavirus COVID-19, where travelers are obliged to cancel or postpone their confirmed reservation date due to travel restrictions introduced by the national governments of guests’ countries of origin or residence, or by Peru’s own national government, or in the event that all international airlines which currently serve routes to Peru cancel frequencies to Peru or our destinations within Peru, making it impossible for guests to initiate their itinerary, Andean Adventures Peru envisages a flexible cancellation and/or postponement policy.
In the event of cancellation:
The company agrees to provide a refund against the tour price paid, minus any and all nonrefundable costs and commissions paid to third parties, and minus any and all nonrefundable bank or credit card charges incurred at time of purchase or resulting from the refund process.
Flexible postponement:
Travelers may reschedule their arrival dates, for any available date up to two years from their original scheduled arrival date.
In the event that a client is obliged to reschedule their arrival date as a result of issues related to the global coronavirus situation, they may do so by informing the company at least 72 hours before their scheduled arrival date.
Andean Adventures Peru will not charge a penalty or apply any additional costs for such changes. Confirmation of new dates will remain subject to availability on the part of our service providers (for example, hotels and airlines) and available places (for example, the network of Inca Trails).
Documentation:
The motive for cancellation or postponement under the aforementioned conditions must be accompanied by relevant documentation supporting the request by the guest or guests, or where applicable, a medical certificate.
Inca Trail to Machu Picchu bookings:
Andean Adventures Peru books and pays the Ministry of Culture in advance for permits required for trekking itineraries that include the Inca Trail (such as Inca Trail 4-days / 3-nights; Inca Trail 2-days / 1-night; Inca Trail 5-days / 4-nights; Mount Salkantay – Inca Trail 7-days / 6-nights). The prices of these itineraries, which include entrance tickets to the Inca Trail, porters, cooks and train tickets, are non-refundable.
In the event of failure to arrive (no-show), the company will retain the full amount paid:
Andean Adventures Peru cannot be held responsible for any failure of a client to arrive due to cancelled or delayed flights. Nor can the company be held responsible for any damage to or loss of luggage, accidents, or unforeseeable circumstances. In the event of any such circumstance, upon request the company will provide a certificate to the client for insurance purposes.
Unused services:
In the event of a client leaving a tour for any reason, any extra expenses incurred shall be the client’s responsibility and the company cannot be held liable for any refund, either total or partial, of monies paid for any and all unused services.
Andean Adventures Peru is not responsible for its third party providers
At Andean Adventures Peru, we work with a variety of travel providers, including airlines, hotels, tour operators, car rental companies and other independent contractors (“Third Party Providers”) to provide you with the best possible travel experiences. Although we take all necessary steps to carefully select our Third Party Providers, we have no direct control over them, and cannot be held responsible for their actions or omissions.
The travel services provided by our Third Party Providers are subject to their own terms and conditions, which may limit their liability in certain circumstances. We cannot guarantee that Third Party Providers will comply with the laws of your country of residence, or those of any other jurisdiction.
We want you to have a pleasant and stress-free travel experience, but we are not responsible for any inconvenience, anguish, distress or frustration that may arise from the acts or omissions of any Third Party Provider or independent contractor. Neither Andean Adventures Peru nor any carrier can be held responsible for any damage or loss arising from the negligence or other actions of our Third Party Providers or their contractors.
Please note that any travel-related documents, such as airline tickets, hotel vouchers or tour confirmation documents, are subject to the terms and conditions of the applicable Third Party Provider. If you have any questions or concerns about your trip or about the terms and conditions of our external providers, please do not hesitate to contact us.
Travel insurance:
Andean Adventures Peru is not responsible for accidents or unforeseen events that may occur during the trip. Travel insurance is strongly recommended to cover loss of deposit or final monies paid resulting from unavoidable cancellation due to illness or other causes, personal baggage loss, medical expenses, etc. All travelers should be adequately insured against personal accident and medical costs.
We recommend a short-term insurance policy that covers the trip selected, with cover in the event of illness, accident, emergency evacuation, costs incurred due to flight delays, schedule changes, delays caused by bad weather, missed connections, strikes, natural disasters, or unforeseeable events.
We recommend that all travelers involved in adventure activities such as trekking and excursions to Peru’s jungle region be fully insured.
Andean Adventures Peru recommends that all travelers have insurance that covers, in addition to emergency medical expenses, Covid-19 related assistance (medical tests, treatment, flight changes, extended in-country stay during quarantining).
IDEAL PHYSICAL FITNESS AND HEALTH CONDITIONS
For Andean Adventures Peru, the safety and well-being of its customers is a priority. As such, customers must provide relevant medical information when booking their tourism Product. Customers may also be required to complete the Andean Adventures Peru Medical Information form, in order to ensure that they are fit to travel and can complete the activities included in the tour Product.
If a Customer indicates that they have a pre-existing medical condition that may impact their ability to travel, participate in the tourism Product, or affect the travel experience of others, they must submit a Medical Form signed by a licensed physician to Andean Adventures Peru before or in conjunction with their final payment. Information provided on the medical form must be honest and accurate, and the customer agrees to disclose all pertinent medical information. Andean Adventures Peru will keep the information strictly confidential, in accordance with its Privacy Policy.
Andean Adventures Peru reserves the right to request more information or professional medical opinions in certain cases where such a measure is considered necessary for the safety and well-being of the customer or other customers traveling with Andean Adventures Peru, or for the safe operation of the tourism Product. In cases where Andean Adventures Peru deems it necessary to deny a customer permission to travel or participate in the tourism Product, if requested the client will receive a written explanation of the decision.
Customers are responsible for evaluating their own suitability and ability to participate in the tourism Product they have booked. They should consult their physician regarding their fitness to travel, particularly in the case of adventure travel. Andean Adventures Peru encourages its customers to seek the advice of their physician regarding any necessary vaccinations, medical precautions, or other medical concerns that may be relevant to their trip with Andean Adventures Peru.
Adventure travel, as offered by Andean Adventures Peru, involves visiting remote or less developed regions where medical facilities may not meet the standards of those found in the customer’s country of origin. The condition of medical facilities in the countries in which Andean Adventures Peru operates varies, and Andean Adventures Peru makes no representation or guarantee regarding the standard of such facilities or the medical treatment available in those regions.
Customers must evaluate the risks and requirements of each Product in light of their limitations, physical and mental condition, and any medical requirements or problems they may have. Andean Adventures Peru or its Third Party Providers may refuse to transport women who are more than 24 weeks pregnant, or customers with certain conditions, if suitable accommodation or alternative Products or services cannot be arranged.
KNOWLEDGE AND ACCEPTANCE OF RISKS
The Customer acknowledges that the nature of Andean Adventures Peru tours is adventurous and may involve a significant amount of risk to the Customer’s health and/or safety. There are inherent dangers in adventure travel in general and Customers acknowledge that they have considered such health and safety risks and are willing to assume them, when confirming their reservation of said Product. The Customer hereby assumes all these risks and hereby releases Andean Adventures Peru from all claims and causes of action arising from any loss, damage or injury or death resulting from these risks inherent in travel, including travel with Andean Adventures Peru specifically, the visiting of foreign destinations and participation in adventure activities such as those included in the itineraries of the Products. Hygiene, accommodation and transportation standards in some countries where Andean Adventures Peru trips are made are often lower than comparable standards that the Customer can reasonably expect in their country or region of origin. The Customer acknowledges that the degree and nature of personal risk involved depends on the nature of the Product booked, or the location(s) in which such a Product is to operate, and that there may be a significant degree of personal risk involved in travel associated with the Product, particularly if the Product involves physical activity, travel to remote locations, transportation by boat, participation in “extreme sports” or other high-risk activities, or travel to countries with underdeveloped infrastructure. The Customer acknowledges having considered the risks, dangers and potential challenges in the light of their own abilities and personal needs, and expressly assumes the risks involved in traveling in such conditions. The Customer acknowledges and accepts that Andean Adventures Peru is not responsible for providing information or guidance to the Customer regarding local customs, weather conditions, specific safety concerns, physical challenges or current laws, in any place where the Products are operated. The Customer must at all times strictly comply with all applicable laws and regulations of all the countries and regions visited during the applicable tourism Product. If the Customer does not comply with any of the above or commits any illegal act during the tour or, if in the reasonable opinion of Andean Adventures Peru, the Customer’s behavior is causing or may cause danger, anguish or material annoyance to other customers or fellow travelers, Andean Adventures Peru may terminate that Customer’s travel arrangements for any Product, immediately and without any liability on the part of Andean Adventures Peru, and the Customer shall not be entitled to any refund for unused or lost services or costs incurred as a result of the termination of their travel arrangements, including, without limitation, return travel, lodging, meals and/or incidentals. Customers accept that they are responsible for any costs incurred by Andean Adventures Peru, Andean Adventures Peru’s suppliers, or Andean Adventures Peru’s partners, as a result of damage, destruction, theft or excess cleaning expenses occasioned or caused by the Customer during the tour. The Customer agrees to report immediately any pre-existing damage of this type to the staff of the accommodation, transport service or facility (as applicable) and/or to a representative of Andean Adventures Peru, as soon as possible upon discovery of any such circumstance by the Customer. The Customer agrees to take all prudent measures in relation to their own safety while participating in any Andean Adventures Peru tourism Product, including, but not limited to, the appropriate use of safety devices such as seatbelts, harnesses and helmets, and to obey all posted signs and warnings regarding Customer health and safety. Neither Andean Adventures Peru, nor its Third Party Providers, will be responsible for any failure on the part of the Customer to comply with the safety instructions or recommendations of Andean Adventures Peru or its Third Party Providers. The Customer agrees to submit any complaint regarding a Product to Andean Adventures Peru as soon as possible, in order to provide Andean Adventures Peru with the opportunity to address any such complaint appropriately. The Customer agrees to inform their Tour Leader or another designated representative of Andean Adventures Peru at the first opportunity, or Andean Adventures Peru directly.
Regarding mountainous terrain:
The mountainous areas where Andean Adventures Peru operates many of its itineraries possess a geographical configuration which in its natural state can present difficulties or dangers that may be concealed by snow, grass or vegetation. Some of these difficulties or obstacles can include, while not being limited to, loose rocks, trees, accumulated vegetation, fast flowing rivers carrying rocks or stones, fallen vegetation, hollows or depressions below the surface, varying water quality and challenging climatic conditions.
Due to the presence of natural forests, rough and rugged terrain or bad weather, participants might become lost or separated from their guides or the rest of the group. Communication in mountainous terrain is often difficult and in the case of an accident, immediate rescue and medical assistance may be unavailable. Weather conditions may be extreme and can change quickly and without warning.
In the event of emergency:
In the event of an accident or illness during an excursion or adventure activity, Andean Adventures Peru, through its guides or support personnel, will provide all the assistance possible in the circumstances. In the event that specialist evacuation is required (helicopters, all-terrain vehicles, boats, medical and/or nursing staff, and/or other medical assistance beyond basic first aid treatment), Andean Adventures Peru cannot be held responsible for such services.
Information and orientation talk provided to tourists
As an operator of adventure tourism services, before starting a trekking or mountain biking program or trip to the jungle, Andean Adventures Peru offers an information and orientation talk to all participating clients, in order to inform them regarding the following points:
- a) Minimum physical conditions necessary for participation in the activity.
- b) Risks that may arise during participation in the activity.
- c) Conditions under which the itinerary is practiced (altitude, climate, inherent risks, among others).
- d) Behavior that must be observed during participation in activities.
- e) Safety measures that must be followed while the service is being provided.
- f) Information regarding the location where the activity will take place.
- g) Information regarding the specialist personnel who will provide the service.
- h) Information on the necessary and authorized equipment for participation in the activity.
- i) Information on Incident and/or Accident Records.
- j) Provision of Risk Management and Emergency Attention measures.
After the talk, the participants in the activity must sign the form indicating that they have attended the talk and received the information provided. In the case of minors, the form must be filled out and signed by a parent, guardian or legal representative.
